ORDER ESTABLISHING UNIFORM CIVIL MOTOR VEHICLE INFRACTION FINES AND FEES SCHEDULE FOR CIVIL TRAFFIC VIOLATIONS UNDER TITLE 14, NAVAJO NATION CODE

                The Navajo Nation Courts are responsible for collecting fines and fees from individuals who violate a provision of the Navajo Nation Motor Vehicle Code. Title 14 N.N.C. §205 grants the District Court judge the discretion to determine the amount of the fee the court will collect from the individual.
Pursuant to 14 N.N.C. §205, an individual who commits a civil motor vehicle infraction is subject to a fee of not less than $37.50 and no more than $500.00. However, this broad fee assessment range has resulted in individuals being subjected to different fees in different Judicial Districts district courts for the same motor vehicle infraction.

                The purpose of this administrative order is assure fair remedies in civil traffic matters by establishing a uniform civil motor vehicle infraction fine and fee schedule. By implementing a standard civil assessment fine or fee for each infraction, each individual will pay the same fine or fee that another individual will pay at a different district court for the same infraction.

                To set this internal court policy through consultation and consent, I gathered all the judges for a meeting to propose the use of an agreed upon civil motor vehicle infraction fines and fees schedule. All District Court judges reviewed the uniform fines and fees and all judges agreed to the implementation of a uniform fine or fee for each civil motor vehicle infraction.

                Accordingly, pursuant to my authority vested under 7 N.N.C §371, I hereby establish a Uniform Civil Motor Vehicle Infractions Fines and Fees Schedule to be applicable hereafter in al Courts of the Navajo Nation to all civil traffic violations under Title 14. The uniform fines and fees schedule is attached as Exhibit “A”.

                This order is effective April 13, 2017, and supersedes any schedule established previously by my office or by any local judicial district.
